Lease vs. Sublease: The Legal Framework
A lease (nájem) is a contract directly between the owner of the apartment and the tenant. It is heavily protected by the Czech Civil Code, which restricts when a landlord can terminate the agreement and guarantees basic tenant rights.
A sublease (podnájem) is a contract between the tenant (now acting as the sublandlord) and a subtenant. The subtenant has significantly fewer rights and protections. If the main lease ends, the sublease terminates automatically.
The Landlord Consent Pitfall
Under § 2275 of the Civil Code, if the tenant does not permanently live in the apartment with you, they MUST obtain written consent from the property owner to sublet.
If you sign a sublease without the owner's written consent, it is a severe breach of the main lease, which can lead to immediate eviction for both the tenant and you.
OAMP Visa and Residence Application Risks
The Ministry of the Interior (OAMP) is extremely strict regarding housing proof (Doklad o zajištění ubytování). For a lease, you only need the signed lease agreement or a signature-verified accommodation confirmation.
For a sublease, the OAMP requires proof that the sublandlord is authorized to sublet. This means you must submit either the written consent of the owner or the main lease showing that subletting is allowed. If this chain is not fully documented and verified, your residence permit or visa application can be rejected.
