Withdrawing from a Contract in Czechia 2026: When You Can and the 14-Day Myth

Foreigners often assume every contract has a 14-day cooling-off period. Under Czech law you can withdraw (odstoupit) only where the parties agreed it or the law allows it (§ 2001 of the Civil Code). The consumer 14-day right (§ 1829) is a specific protection — not a general escape from any deal.

There is no general right to walk away

A signed contract binds you. Withdrawal is possible only if the parties agreed on it or a statute provides for it (§ 2001).

This differs from termination (výpověď), which ends an ongoing relationship for the future, and from a mutual cancellation agreement.

When withdrawal is allowed

A common statutory ground is a material breach by the other party (§ 2002) — for example the seller fails to deliver or the buyer fails to pay.

Parties can also agree their own grounds in the contract, such as delay beyond a set number of days. Writing these grounds down avoids argument later.

What withdrawal does

Withdrawal cancels the obligation from the outset (§ 2004(1)). The parties generally return what they already exchanged — goods for money.

The right to a contractual penalty or to damages caused by the breach usually survives. Withdraw in writing and keep proof of delivery.

The consumer 14-day right (§ 1829)

  • Applies to consumers for distance contracts (e-shops, phone) or off-premises contracts (doorstep, sales events).
  • Does not apply to an in-person deal between two private individuals, nor between businesses.
  • The 14 days usually run from receipt of goods; an unsolicited visit or promotional event extends it to 30 days.
  • Some contracts are excluded — for example goods made to order (§ 1837).
